Smarthire Screening Services India Private Limited, (the “Company”) combines the latest Internet technologies with an experienced, professional staff to deliver a proven resource to hundreds of clients across a variety of industries. Processing large numbers of reports daily, the Company offers a variety of background screening packages for businesses of any size. The consent of the candidate(the person whose  Background Verification is to be done) is taken prior to starting the Background Verification process. The Company complies with all the rules and regulations that govern the matters related to privacy of personal information and the background verification in India. Some of these are: 

1. The Information Technology Act, 2000 and amendments:  

    An Act to provide legal recognition for transactions carried out by means of electronic data interchange and other means of electronic communication, commonly referred to as ―electronic commerce‖, which involve the use of alternatives to paper-based methods of communication and storage of information, to facilitate electronic filing of documents with the Government agencies and further to amend the Indian Penal Code, the Indian Evidence Act, 1872, the Banker’s Books Evidence Act, 1891 and the Reserve Bank of India Act, 1934 and for matters connected therewith or incidental thereto. 

    2. The Credit Information Companies (Regulation) Act, 2005 

      The Credit Information Companies (Regulation) Act, 2005 (CICRA), is a legislation enacted by the Government of India to regulate the actions of credit information companies in India (“CIC’s”) in India and to facilitate efficient distribution of credit as well as for matters connected to the same. 

      Currently, there are four CICs licensed by the Reserve Bank of India — Credit Information Bureau (India) Ltd (CIBIL), Equifax Credit Information Services Pvt Ltd, Experian Credit Information Company of India Pvt Ltd and CRIF High Mark Credit Information Services Pvt Ltd. 

      More entities will become eligible to tap into information with Credit Information Companies (CICs), going by the eligibility criteria prescribed by the Reserve Bank of India for entities to be categorised as specified users of CICs. 

      Besides, the governing statute of the Statutory Corporation or Memorandum of Association of the Company, as the case may be, should allow the business/activity of processing of information for the support or benefit of credit institutions. 

      3. Sensitive Personal Data or information  Rules, 2011 

        In adherence to data protection provisions under the IT Act, the Central Government has enacted the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules 2011 (hereinafter, “The SPDI Rules”). The SPDI Rules are applicable only to body corporates and individuals acting on behalf of body corporates. The SPDI Rules encompasses provisions to regulate: 

        a. Processing of Personal Data/Information and/or Sensitive Personal Data/Information 

        b. Prescribing security practices and procedures for handling Personal Data/Information and/or Sensitive Personal Data/Information. 

        The SPDI Rules protect natural persons residing in India. Therefore, the collection of information/data of a firm, partnership, trust, company, LLP, etc. will not attract data protection requirements under the SPDI Rules. 

        The IT Act and the SPDI Rules are only applicable to information and data collected in cyberspace and have no application on information and data collected through offline/physical modes. 

        APPLICABILITY 

        • If a body corporate is located in India: SPDI Rules are applicable. 
        • If a body corporate is located outside of India: SPDI Rules are applicable only if the body corporate has a computer, computer system or computer network located in India. 

         Data categorisation under SPDI Rules

        Further, Sensitive Personal Data or Information has been defined as personal information which consists of information relating to: 

        a. Password 

        b. Financial information
